Is Kratom Legal in Virginia in 2023?

Virginia is booming with vape shops, smoke shops and specialty stores that carry Kratom products. Kratom is very popular in Virginia, and in 2023, it is also completely legal here. However, it has not been without controversy, and there was a risk of Kratom being banned. However, on March 27, 2023, Virginia became the ninth state to ratify the Kratom Consumer Protection Act.

Laws and legislation of Kratom in Virginia

Recently, legislators introduced a bill to have the Virginia Board of Pharmacy study Kratom and recommend whether to ban or regulate it. Unfortunately, the bill was tabled in committee. The American Kratom Association hopes to garner support for the regulatory bill in an upcoming session.  

Kratom is legal at a federal level, but at a state level, it is up to the individual states to decide on their own individual Kratom laws. While Kratom is currently legal to purchase, possess and sell, a partisan bill VA HJR39 was issued in January 2020 to ban Kratom. Advocacy groups leaped into action to stop this bill, and Kratom remains legal in Virginia.
