Kratom is legal in Kentucky. There have been several efforts to regulate Kkratom, typically by lawmakers attempting to register it as a controlled substance. As it now stands, kratom is legal to possess, purchase, consume and distribute.

Kratom is a natural herb from the coffee family (Rubiaceae). It is a large, tropical, evergreen tree grown in Southeast Asia. The leaves of the kratom tree have been used for centuries for medicinal purposes. Field workers used kratom to supply energy and endurance and relieve discomfort from long hours of working in the fields. The kratom leaves contain two principal alkaloids, Mitragynine and 7-Hydroxymitragynine. These two alkaloids are often targeted by those who want to ban kratom. As a result, this tropical plant has endured constant controversy with the FDA — as most medicinal plants have. Fortunately, kratom remains legal in Kentucky.

However, the bill died in committee. In 2021, the Kentucky legislature introduced Senate Bill 241. This bill would have regulated Kkratom. Most Kratom enthusiasts supported the bill, which would prohibit the manufacture and sale of certain Kratom products and extracts, prohibit financial institutions from denying services to Kratom producers and retailers, and establish penalties for the violations of the bill. However, the bill failed to pass but may be revised and submitted in upcoming sessions.
