Is Kratom Legal in New York?
Kratom is legal in New York but hasn’t come without recent significant legislative challenges. However, between 2016 and 2017, all challenges failed to make Kratom illegal. So in New York, producing, selling, transporting, and possessing Kratom is legal and without age restriction.
History of Kratom legislation in New York
It is legal in New York, despite the attempts of authorities to restrict and regulate it. The first attempts to ban Kratom occurred in 2016 and 2017 when Senate Bill 168 was introduced into the state legislature. It proposed limiting the sale of Kratom to people 18 years of age and older. Later that same year, Senate Bill 6924 was introduced again, attempting to limit the age to 18. Then two more attempts were made that same year, except this time, the hope was to limit the age to 21 or older. Unfortunately, each of these bills died in committee. Then, in January 2017, partisan bill A294 was introduced in the State Senate, which would have banned Kratom completely. Fortunately, that bill did not even make it out of the committee.
How to buy Kratom in New York
Kratom is legal to purchase from dispensaries, head shops or any market. Vendors can ship in-state or out-of-state to any New York address. The FDA does not recognize Kratom, meaning vendors have no regulations to comply with. Incidents of contaminated or adulterated Kratom sold on the market have hurt Kratom’s reputation.
Your best bet is to buy from a reputable Kratom vendor. These vendors are typically online vendors who subscribe to best manufacturing practices. Advocacy by the American Kratom Association
Much of the success can be credited to the hard-fought work of the American Kratom Association, a 501c3 advocacy group supporting the legalization and regulation of Kratom. They rallied thousands of supporters through many channels, including a targeted Facebook campaign that flooded the legislators with letters and emails demanding the legalization of Kratom in New York.
In June 2022, the American Kratom Association introduced Bill 2034. The bill, which passed both the Senate and the House, promotes Kratom research and sets merchandising standards to protect consumers from adulterated Kratom. It also calls for standardized requirements for Kratom vendors to have specific, informative labels on all Kratom products. Finally, it pushes the Dept of Food and Agriculture (FDA) to create and enforce standards for Kratom.
