What is Kratom?

Kratom (Mitragyna speciosa) is an evergreen tree native to the rainforests of Southeast Asia and part of the coffee plant family. The farmers in Southeast Asia have become experts in growing and harvesting Kratom, and to this day, the highest quality Kratom available in the world comes from this region. Harvested Kratom has helped farmworkers manage long and arduous work days for centuries.

Kratom leaves contain two alkaloids: Mitragynine and 7-α-hydroxymitragynine—these act on the opioid receptors in the brain. Depending on the strain and vein of Kratom and the dosage, Kratom can have stimulant effects, calming effects, or relief from discomfort. Traditionally, people chewed Kratom leaves or brewed them to make tea. Today, Kratom can be taken conveniently in powder, capsules, and extracts.

Laws and legislation of Kratom in Maine

Kratom is legal to possess, consume, purchase and distribute in Maine. Currently, Kratom is also without any classification in Maine.

There were attempts to ban Kratom in Maine in a bill introduced in 2017. That bill would have prohibited Mitragynine, Kratom’s most prevalent alkaloid. The Maine Senate amended the bill, and Mitragynine was left out. There were several substances that this bill intended to target and place on the Schedule W controlled substance list. (That list included opium, morphine, heroin, methadone, amphetamine, and other drugs.) The discussion to add Mitragynine to the list greatly concerned Kratom enthusiasts, and supporters were alerted and urged to help fund a lobbying effort against Kratom’s inclusion. The American Kratom Association and the Botanical Education Alliance were key organizations actively involved in this effort. As a result, the bill was defeated.

This advocacy led to a bill introduced in 2019 for the Kratom Consumer Protection Act. However, that bill died in committee. As a result of these failed bills, Kratom is entirely legal in Maine but is also still unregulated.
