Is Kratom Legal in Massachusetts in 2024?

Kratom (Mitragyna speciosa) is an evergreen tree native to the rainforests of Southeast Asia and part of the coffee plant family. Laws and legislation of Kratom in Massachusetts

Even though Kratom is legal in Massachusetts, the state’s House of Representatives has tried to ban the popular herb. In 2009, House Bill 1789 attempted to categorize Kratom as a Class B substance under Massachusetts law. Class B substances include cocaine, morphine, and LSD. Possessing, trafficking, and consuming Class B substances can lead to a $1,000 fine and jail time. Fortunately, the bill did not pass.

Two years later, House Bill 526 also aimed to classify Kratom as a Class B substance. However, the bill never made it through the legislature. Finally, in 2013, Massachusetts lawmakers considered passing a bill banning Kratom altogether, but they never were able to get a bill passed. As a result, today, in 2022, Kratom is legal throughout Massachusetts. No city councils or county-based governing bodies have restricted the possession or sale of Kratom within their borders. As a result, you are free to possess, purchase and distribute Kratom throughout the state.

The KCPA would also create a certification program for Kratom retailers and manufacturers.

The Kratom Consumer Protection Act is under consideration in more than 20 states. As of 2023, the KPCA has passed in the following states: Utah, Georgia, Arizona, Oregon, Nevada, Colorado, Missouri and Oklahoma.
