Is Kratom Legal in Vermont in 2024?

Nicknamed “The Green Mountain State,” Vermont is beautiful—but as with every state, some things may disappoint you. As you will discover below, kratom legislation is one of them. Unfortunately, despite Vermont being perceived as a liberal state, kratom is not legal here. That being said, there is reason to be hopeful that change is on the horizon. So, what gives—is kratom legal in Vermont? Unfortunately, no. Vermont is just one of six states that have banned the use of kratom, joining Alabama, Arkansas, Indiana, Rhode Island, and Wisconsin. Let’s expand on this conversation and examine the laws and legislation surrounding kratom in Vermont.

Up-to-date laws and legislation of kratom in Vermont

In 2016, the two main alkaloids found in Kratom- Mitragynine and 7-Hydroxymitragynine were added to the controlled substance list in Vermont, making kratom illegal here. The good news is that an open bill currently aims to decriminalize kratom and other herbs such as psilocybin, ayahuasca and peyote.

According to a petition filed with the Vermont Department of Health to remove mitragynine and 7-hydroxymitragynine from the Regulated Drug Rule, the Department granted the petition submitted by the American Kratom Association (AKA) on March 1, 2023. It will commence rulemaking shortly to complete that process: “This email is to apprise you that the Department is granting your petition to remove mitragynine and 7-hydroxymitragynine from the Regulated Drug Rule.”

Until that changes, the kratom ban continues to exist. This has caused a lot of confusion for Vermont residents and has resulted in lawmakers beginning to develop wording on a new bill to clarify classification.

Current efforts for advocacy in Vermont

The American Kratom Association (AKA), founded in 2014, is a non-profit organization that champions the cause of kratom. Its mission is to preserve kratom freedoms, advocate for regulatory measures, and promote research. The American Kratom Association has been the driving force behind kratom regulations across the country. By tirelessly working to make kratom legal across all states, AKA empowers individuals to contribute to the cause by becoming a “protector” of kratom. You can join that effort here.

In collaboration with the AKA, the Botanical Education Alliance devotes itself to increasing awareness about the benefits of natural supplements like kratom among consumers, law enforcement, policymakers, and the media. They aim to shape public policy to safeguard these natural supplements. Currently, over 20 states are considering the Kratom Consumer Protection Act. As of 2024, 12 states adopted the Act. They are Arizona, Colorado, Florida, Georgia, Kentucky, Nevada, Oklahoma, Oregon, Texas, Utah, West Virginia, and Virginia.
