Is Kratom Legal in Utah in 2022?

Laws and Legislation of Kratom in Utah

In March 2017, an attempt to criminalize Kratom went down to defeat. House Bill 110 would have added Kratom to the Utah Controlled Substances Act. Then in March of 2019, Utah broke the mold for Kratom when it became the first state to pass the Kratom Consumer Protection Act (KCPA).

Instrumental in its passage was the American Kratom Association and its lobbyist, Mac Haddow, who happened to have led the first Senate campaign for the eminent Sen. Orrin Hatch (R-Utah). In addition, this groundbreaking legislation led the way for three other states – Georgia, Arizona and Oregon – to pass similar legislation that year. 

Under this bill, Kratom vendors must: 

  • perform approved lab tests to test for purity and alkaloid content 
  • label their Kratom products to include the place of origin, ingredients and alkaloid content 
  • Prohibit the sale of any Kratom products containing contaminants, impurities, pathogens or illegal substances
  • Dispose of any impure Kratom 
  • Only sell Kratom to individuals who are 21 or older 
  • Face jail time or fines if not in compliance with these regulations.

The Kratom Consumer Protection Act (KPCA) is legislation the American Kratom Association introduced that encourages advocacy for Kratom education and research. In addition, it sets legal guidelines for the industry regarding labeling, ingredients, and age restrictions. The Act prohibits the sale of adulterated or misbranded Kratom. The KCPA would also create a certification program for Kratom retailers and manufacturers. The Kratom Consumer Protection Act is under consideration in more than 20 states, says a spokesperson for the American Kratom Association. As of 2022, the KPCA has passed in the following states: Utah, Georgia, Arizona, Oregon, Nevada, Colorado, Missouri and Oklahoma.
