Is Kratom Legal in Texas in 2024?

Good news for Texans who use the herbal supplement Kratom. In 2023, Kratom is legal in Texas. This belies the popular belief that Texas drug laws are conservative and penalizing. Years before, they leaned toward crime and punishment; today, the focus is more on treatment and rehabilitation. In the following article, you’ll learn more about Kratom in Texas.

Is Kratom legal in Texas?

Herbal supplements like Kratom have a growing reputation for being a great natural alternative to mainstream prescription drugs. Fortunately, most Texas legislators have agreed, and there has been no attempt to ban Kratom. Therefore, you can sell, distribute and consume Kratom anywhere in Texas.

Kratom is legal at the federal level. However, its legality is tenuous because the Food and Drug Administration (FDA) has neither approved nor sanctioned it (as they do other herbal supplements). In the recent past, the FDA has had a very aggressive stance on Kratom, so even more misconceptions are spread. In addition, due to the FDA not regulating Kratom, individual states can pass legislation banning it, making it legal or restricting its use. Another downside to the FDA not including Kratom as a registered and regulated supplement is that anyone can sell Kratom, and quality is not guaranteed.

How can I buy Kratom in Texas?

Kratom can be purchased and shipped to and from Texas. Kratom is also readily available in smoke shops, convenience stores and dispensaries. But buyer beware, for fresh and unadulterated Kratom, your best choice is to purchase from a local online vendor. A favorite online Kratom vendor in San Antonio is Kingdom Kratom, one of the leading Kratom suppliers in the United States. They focus on delivering the highest quality Kratom, using only all-natural, organic, sustainably sourced ingredients.

The AKA and Kratom advocacy in Texas

The American Kratom Association (AKA) is a non-profit advocacy group established in 2014, committed to preserving and protecting the freedom of Kratom or Mitragyna Speciosa. It advocates for continued regulation to ensure Kratom quality and also for increased research on the benefits of Kratom. The AKA continues to work tirelessly to have Kratom legal in every state, including Texas. You can help in that effort by joining the AKA as a “protector” of Kratom. You’ll then receive notification of any changes to laws and any advocacy needed. Join the email list here.

The Kratom Consumer Protection Act

The Kratom Consumer Protection Act (KPCA) is legislation the American Kratom Association introduced that encourages advocacy for Kratom education and research. In addition, it sets legal guidelines for the industry regarding labeling, ingredients, and age restrictions. The Act prohibits the sale of adulterated or misbranded Kratom. The KCPA would also create a voluntary certification program for Kratom retailers and manufacturers. The Act almost passed last year’s Texas legislature; legislators intend to reintroduce it in the next session.

The Kratom Consumer Protection Act is under consideration in more than 20 states, says a spokesperson for the American Kratom Association. The organization hopes that Texas will soon join the eight other states where versions of the legislation have passed. The KPCA has passed in Utah, Georgia, Arizona, Oregon, Nevada, Colorado, Missouri and Oklahoma.
