What is Kratom?

The Kratom tree, also known as Mitragyna speciosa, is a tropical evergreen native to the rain forests of Southeast Asia, specifically Indonesia, Malaysia and Thailand. Kratom trees thrive in this environment due to the hot and humid climate. For centuries, workers in the field have used the leaves of the Kratom tree for medicinal purposes and as a worker’s aid to supply energy and endurance. Kratom leaves contain the two principal alkaloids, Mitragynine and 7-Hydroxymitragynine, the ingredients responsible for the benefits experienced with Kratom. These two alkaloids are found only in Mitragyna speciosa tree.

Kratom trees reach heights of up to 100 feet, with varying sizes of glossy green leaves that bear different stem and vein colors depending on the tree’s origin and the age of the leaves. This color defines the color family of the Kratom leaves. Each color family possesses several Kratom strains, each with a unique alkaloid profile and benefits. Traditionally, fresh or dried Kratom leaves are chewed or made into a tea and seldom smoked. Kratom has stimulant effects at a low dose and is used to combat fatigue during long working hours. At high dosages, however, it can have sedative-narcotic effects.

Delaware does not regulate or classify Kratom. There is no past or pending legislation in the state either. Therefore, Kratom is entirely legal to possess, purchase, distribute and consume in Delaware.

The Kratom Consumer Protection Act (KPCA) is legislation the American Kratom Association introduced in various states. It advocates for Kratom education and research. In addition, it sets legal guidelines for the industry regarding labeling, ingredients, and age restrictions. The Act prohibits the sale of adulterated or misbranded Kratom. When passed, the KCPA creates a certification program for Kratom retailers and manufacturers.

The Kratom Consumer Protection Act is under consideration in more than 20 states, says a spokesperson for the American Kratom Association. The organization hopes Delaware will soon join the eight other states where versions of the legislation have passed as of 2022. The KPCA has passed in Utah, Georgia, Arizona, Oregon, Nevada, Colorado, Missouri and Oklahoma.
