Is Kratom Legal in Nevada?

Kratom is legal in Nevada. In June 2019, Nevada also became the fourth state to pass the Kratom Consumer Protection Act (KCPA). The Kratom Consumer Protection Act protects Nevada consumers from adulterated Kratom products and requires labeling that allows consumers to know exactly what is in any kratom product they purchase. The bill also bans the sale of Kratom products to anyone under 18. In addition, regulations ensure that Kratom vendors adhere to guidelines and that their products are safe for consumers. 

While the passage of the KCPA typically breathes a sigh of relief for all Kratom consumers, there’s always the chance that some group might still challenge its legality. This happened on April 14, 2019, when the Nevada State Board of Pharmacy called a public hearing to reconsider Kratom’s legal status, calling for it to be listed as a Schedule 1 controlled substance. Fortunately, the pharmacy board removed the request from the agenda due to advocacy by the American Kratom Association and passionate Kratom consumers.

The KCPA would also create a voluntary certification program for Kratom retailers and manufacturers. The Act almost passed last year’s Texas legislature; legislators intend to reintroduce it in the next session. 

The Kratom Consumer Protection Act is under consideration in more than 20 states, says a spokesperson for the American Kratom Association. As of 2023, the KPCA has passed in Utah, Georgia, Arizona, Oregon, Nevada, Colorado, Missouri and Oklahoma.
