Kratom is currently legal in Maryland, but in January 2020, Senate Bill 147 was filed, which would have criminalized Kratom by banning mitragynine and 7-hydroxymitragynine, the two main alkaloids in Kratom. If passed, this bill would have categorized Kratom as a Schedule I controlled substance, but thankfully the bill died in committee. The sponsor of that bill (Senator Young) supported replacing the ban with an 18 and under restriction. After solid lobbying and education by the American Kratom Association, he now advocates for an expanded review of the Kratom Consumer Protection Act (KPCA) in Maryland. So, for now, Kratom remains legal in Maryland. However, since the federal government does not regulate Kratom, it means that at any given time, state laws can change. Therefore it’s essential to keep abreast of the legality of Kratom where you live.
