History of legislation in Arizona

Like in many states, the legality of Kratom in Arizona has not been without its challenges. In 2014 the Arizona Legislature introduced HB 2453 into the Senate. The “Controlled Substances Act” initially added Mitragynine and 7-Hydroxymitragynine, the two main alkaloids found in Kratom, and identified them as synthetic substances. Kratom supporters successfully petitioned against the inclusion since Kratom is a 100 percent natural plant product.

“It needs to be made clear that Mitragynine and 7-Hydroxymitragynine, are natural compounds found in the leaves of Kratom,” according to the petition circulated by the advocacy group, Change.org. “Kratom is not artificial and does not belong on this list of banned synthetic substances. Including them in this ban will hinder citizens in your state from seeking continued medical benefits from this plant.”

Fortunately, legislators removed Kratom from that list before passing the bill.

Efforts to regulate Kratom in Arizona

In 2018, the Arizona legislature passed the Kratom Consumer Protection Act, which regulated Kratom’s sales, production, labeling and distribution. It also placed a minimum age requirement of 18 years of age. Kratom is now legal to possess, purchase and distribute for anyone 18 or older in Arizona. Kratom is entirely legal at the federal level. However, since no federal legislation exists, individual states can make their own legislation. As of 2022, Kratom remains unclassified in Arizona.

In 2019, the Arizona legislature passed HB 2550, the Kratom Consumer Protection Act (KCPA). The legislation prohibits the sale of Kratom products to minors and creates requirements for product labels.
