Is Kratom Legal in South Dakota in 2024?

South Dakota is home to this world wonder, so it should be no surprise that it is nicknamed “The Mount Rushmore State.” If you plan to visit this state, you’d be happy to know that in 2023, Kratom is legal here

What is Kratom?

Kratom (Mitragyna speciosa) is an evergreen tree native to the rainforests of Southeast Asia and part of the coffee plant family. Kratom leaves contain two alkaloids: mitragynine and 7-α-hydroxymitragynine—these Act on the opioid receptors in the brain. Is Kratom legal in South Dakota?

In 2020, House Bill 1072 was filed in the South Dakota House of Representatives to make Kratom illegal. It would have done so by classifying mitragynine and 7-hydroxymitragyninKratomchedule I controlled substances. The bill passed through the Health and Human Services Committee but died in the chamber. The American Kratom Association is working to advocate for the passage of the Kratom Consumer Protection Act.
