Laws and Legislation of Kratom in North Carolina

While Kratom is legal now, it was briefly threatened in 2016 when Senate Bill 830 was put forth. That bill went down to defeat but would have banned Kratom and listed it as a Schedule 1 Controlled Substance. Advocates and supporters quickly squelched the effort, and the bill died in committee. Later that year, House Bill 747 passed, restricting the legal age to purchase Kratom to 18 years old.

The Kratom Consumer Protection Act (KCPA)

The Kratom Consumer Protection Act (KPCA) is legislation the American Kratom Association introduced that encourages advocacy for Kratom education and research. In addition, it sets legal guidelines for the industry regarding labeling, ingredients, and age restrictions. The Act prohibits the sale of adulterated or misbranded Kratom. The KCPA would also create a certification program for Kratom retailers and manufacturers. 

The Kratom Consumer Protection Act is under consideration in more than 20 states, says a spokesperson for the American Kratom Association. As of 2022, the KPCA has passed in eight states: Utah, Georgia, Arizona, Oregon, Nevada, Colorado, Missouri and Oklahoma.
