Laws and legislation of Kratom in Michigan

Kratom is completely legal in Michigan, and one can freely consume, purchase, possess and distribute Kratom. However, since no federal or state legislation regulates Kratom, it remains open to legal challenges.

Attempts to ban Kratom in Michigan have been many. In 2014, House Bill 5805 proposed a ban on Kratom, which would have listed it as a Schedule V controlled substance. The American Kratom Association and other advocacy groups presented a petition in favor of Kratom with more than 1,700 signatures. As a result, the bill went down to defeat. There were other similar attempts between 2017 and 2018, but none were successful. In 2019 Republican Senator John Bizon introduced Senate Bill 0433, attempting to classify Kratom as a Schedule II controlled substance, which would have required a doctor’s prescription to purchase; this bill was also unsuccessful.

Sen. Bizon (who had previously introduced the bill to ban Kratom) will soon file the Kratom Consumer Protection Act, which would provide consumer protection and vendor guidelines. Sometimes, significant changes can be made with a little bit of education and advocacy!

Classification of Kratom in Michigan

For now, there is no classification for Kratom in Michigan, nor any open legislation to try to classify it. However, it is essential to realize that since the FDA does not regulate Kratom, this could change anytime.

The Kratom Consumer Protection Act

The Kratom Consumer Protection Act (KPCA) is legislation the American Kratom Association introduced that encourages advocacy for Kratom education and research. The KCPA would also create a voluntary certification program for Kratom retailers and manufacturers. The Kratom Consumer Protection Act is under consideration in more than 20 states, says a spokesperson for the American Kratom Association. The organization hopes that Michigan will soon join the eight other states where versions of the legislation have passed. The KPCA has passed in Utah, Georgia, Arizona, Oregon, Nevada, Colorado, Missouri and Oklahoma.
